Court sets aside 'illegal' arrest warrant against Karen Baaba Sam

The Achimota District Court, under the leadership of His Worship Prince Osei Owusu, has granted a motion filed by the lawyers of Karen Baaba Sam, setting aside an arrest warrant that she claimed was "illegally" obtained by her ex-partner, Nana Kwadwo Adjei, with the assistance of some elements within the Ghana Police Service.

During the hearing of the motion on Tuesday, February 4, 2025, Baaba Sam’s legal team argued that the arrest warrant had no valid basis and should be rescinded.

The State, represented by Senior State Attorney David Beecham, did not oppose the application, leading the magistrate to set aside the warrant.

As a result, Karen Baaba Sam is no longer at risk of arrest and can continue with her daily activities.

The arrest warrant, dated January 20, 2025, had initially gained attention on social media, where it was reported that Baaba Sam was wanted by the Achimota District Court for questioning by the Police Criminal Investigations Department (CID) in relation to a case of unlawful child removal.

The warrant included personal details about her, such as her age, physical appearance, and a description of her whereabouts.

However, in an affidavit submitted by Karen Baaba Sam, she challenged the validity of the warrant, claiming it was issued based on fraudulent and misleading depositions.

Baaba Sam further stated that the arrest warrant was the result of actions by Detective Inspector Samuel Sakyi, who allegedly fabricated information regarding her taking her daughter and refusing to return her, which she denied.

In her legal filings, Baaba Sam explained that there were ongoing domestic abuse and custody cases between her and Nana Kwadwo Adjei, with the Circuit Court issuing interim protection orders for her and her daughter.

She also stated that the arrest warrant was issued without her knowledge or proper notification, further accusing the complainant of misleading law enforcement authorities through bribery and unlawful influence.

Baaba Sam emphasized that the warrant, its publication, and the actions of her ex-partner had caused her significant harm and distress.

She requested that the court take action to bring those responsible for the wrongful issuance of the warrant to justice.

With the warrant now voided, Karen Baaba Sam remains in legal custody of her daughter under the existing interim protection order granted by the Circuit Court, which is still being reviewed in higher courts.

The court's ruling in favour of Karen Baaba Sam has brought a significant turn to the ongoing legal dispute, and attention is now focused on addressing the alleged misconduct within the Ghana Police Service in handling the matter.
