MOFFA begins enforcement drive to regularise unlicensed mortuaries
The Mortuaries and Funeral Facilities Agency (MoFFA) has issued a strong directive to all public and private mortuaries, funeral homes, and related facilities operating without the required licenses to regularise their operations within one week or risk sanctions, including fines and closure.
In a public notice released by the Agency, MoFFA expressed concern over the increasing number of mortuaries and funeral facilities that continue to operate in violation of the Health Institutions and Facilities Act, 2011 (Act 829).
The law mandates all such establishments to obtain proper licensing before handling the storage, transportation, or disposal of human remains.
According to Section 55 of Act 829, operating without a valid license constitutes an offence and may attract penalties ranging from monetary fines to the temporary or permanent closure of the facility.
“The Agency has observed that a number of mortuaries and funeral facilities continue to operate without licenses, which is contrary to the law,” the statement emphasised.
“All operators are therefore advised to take immediate steps to regularise their operations or face enforcement action.”
The statement, signed by the Registrar of MoFFA, reaffirmed the Agency’s commitment to maintaining professional and ethical standards in the management of human remains across the country.
It also reminded practitioners that MoFFA’s core mandate is to license, control, and regulate all facilities connected to mortuary and funeral operations.
