Court grants OSP leave to serve summons on Ofori-Atta
The High Court has granted an application by the Office of the Special Prosecutor (OSP) to serve criminal summons on former Finance Minister Kenneth Nana Yaw Ofori-Atta (A1) and his Chief of Staff, Ernest Akore (A2), in a case involving alleged unlawful procurement dealings.
The proceedings were held in camera.
The court also admitted five other accused persons—Emmanuel Kofi Nti (A3), Ammishaddai Owusu-Amoah (A4), Isaac Crentsil (A5), Evans Adusei (A7), and Strategic Mobilisation Ghana Ltd (A8)—to GHS50 million bail each, with two sureties required to be justified.
The accused are to deposit all passports and travel documents with the registry and report to the OSP once every week.
Because the court closed later than scheduled, the bail terms will formally take effect on Monday, 15 December 2025, when all five return to complete the bail process.
Until then, they remain on their existing OSP-enforced bail conditions.
According to the Prosecution, the accused persons participated in a scheme that improperly secured procurement contracts for Strategic Mobilisation Ghana Ltd, causing the state to lose more than GHS1.4 billion.
They are alleged to have manipulated procurement processes for unlawful gain and used public office for personal benefit. Prosecutors say additional losses running into billions of dollars were prevented only due to timely state intervention.
The Court adjourned the case to 17 December 2025, when Kwadwo Damoah (A6), Member of Parliament for Jaman South, is expected to appear and take his plea.
The judge declined a prosecution request for a bench warrant after ruling that Damoah had parliamentary immunity at the time the summons was served, since Parliament was in session on the day in question.
