Akosua Serwaah appeals High Court ruling on Daddy Lumba’s surviving spouses
Akosua Serwaah has filed an appeal at the Court of Appeal in Kumasi challenging a High Court decision that recognised both her and Priscilla 'Odo Broni' Ofori, popularly known as Odo Broni, as the lawful surviving spouses of the late highlife musician Charles Kwadwo 'Daddy Lumba' Fosu.
In her notice of appeal, Madam Serwaah is contesting the entire judgment of the Kumasi High Court. She argues that the trial court erred in rejecting and declaring inadmissible a marriage certificate she tendered in support of her claim.
She further contends that the High Court committed an error of law by holding that she failed to meet the requirements of the Evidence Act, 1975 (NRCD 323) for the admission of the marriage certificate into evidence.
Madam Serwaah is, therefore, urging the Court of Appeal to set aside the High Court’s judgment and to declare her the sole lawful surviving spouse of the late musician.
High Court Ruling
On November 28, 2025, the Kumasi High Court, presided over by Justice Dr Dorinda Smith Arthur, dismissed Ms Serwaah’s suit in which she sought a declaration that she was the only surviving spouse of Daddy Lumba.
The court held that the plaintiff failed to prove that she was married to the deceased under the Marriage Ordinance in a manner that would make her the sole surviving spouse.
According to the court, the evidence showed that Daddy Lumba married Akosua Serwaah under customary law, which is potentially polygamous. Consequently, the court found that his subsequent marriage to Priscilla Ofori (Odo Broni) was also valid under Ghanaian law.
In its final ruling, the High Court declared both Akosua Serwaah and Priscilla Ofori as the legally recognised surviving spouses of the late highlife icon.
