Civil Society Coalition granted leave to join Special Prosecutor case as amici curiae

A coalition of civil society organisations has announced that the Supreme Court has granted its application to intervene as amici curiae in an ongoing case challenging the constitutionality of aspects of the Office of the Special Prosecutor Act, 2017 (Act 959).

In a press statement issued on Tuesday, May 19, the coalition said the decision would allow it to present the court with its views on the history of civic advocacy, policy discussions and legislative processes that led to the establishment of the Office of the Special Prosecutor.

According to the statement, the coalition also intends to draw the Court’s attention to international best practices and comparative case law relating to prosecutorial powers, as well as the possible implications of the case on Ghana’s anti-corruption efforts.

The group expressed appreciation to the Supreme Court for granting the application and acknowledged the Attorney-General’s decision not to oppose the request to intervene.

It added that it looks forward to assisting the Court on issues that could shape Ghana’s anti-corruption framework for years to come.
