Anti-LGBTQ Bill: Sam George warns advocates risk legal action

The Member of Parliament for Ningo-Prampram, Samuel Nartey George, has suggested that a social commentator known as Headucator could be liable to prosecution under the proposed Human Sexual Rights and Family Values Bill, 2025, over alleged promotion of same-sex relations.

Contributing to discussions on the Bill on Thursday, April 23, Mr. George maintained that individuals who openly identify with the LGBTQ+ community and advocate such practices could fall within the ambit of the legislation if it is eventually passed.

He explained that for a criminal offence to be established, both the physical act (actus reus) and the intention behind it (mens rea) must be proven, indicating that such legal principles would guide enforcement.

His remarks come amid ongoing stakeholder consultations on the Bill, which seeks to criminalise LGBTQ+ activities in Ghana and continues to generate intense public debate.

Meanwhile, the Member of Parliament for Assin South and sponsor of the Bill, John Ntim Fordjour, has dismissed claims suggesting any form of sexual relationship with transgender musician Angel Maxine.

The clarification follows comments made during the clause-by-clause consideration of the Bill, where issues around public identification and advocacy of LGBTQ+ matters were discussed.

The Human Sexual Rights and Family Values Bill, 2025, is still before Parliament, with consultations ongoing as lawmakers examine its provisions and possible impact.

“There is a gentleman for whom a video was leaked, and an altercation between him and a male lover of him came up last year. A gentleman known as Headucator. Now he can be charged on the basis of the video of male-on-male intercourse.

“That is a different thing. But aside from that video that came out, that individual holds himself out and promotes homosexual activity on his social media page. That person is holding himself out so the actus reus and mens rea can be determined from his activities.

 

“So you take his activities on social media, his public commentary he’s made where he admits his sexual preferences are; the actus reus then goes to what has he been doing; the statement is an evidence of the mens rea, But the actus reus what has he done to actualize the statement that he is this,” he stated.
