J.A. Plant Pool fights Attorney-General’s claims in DRIP contract suit

J.A. Plant Pool (GH) Limited and its Executive Chairman, Joseph Siaw Agyepong, have strongly denied allegations contained in a suit filed by the Attorney-General seeking to recover US$2 million allegedly owed to the Government of Ghana under the District Road Improvement Programme (DRIP).

In a statement issued in Accra, the company described the legal action as being in bad faith and vowed to vigorously defend itself in court.

According to J.A. Plant Pool, the contract in question, dated February 12, 2024, was lawfully executed and fully performed under the DRIP initiative.

The company stated that prior to the execution of the contract, the Public Procurement Authority (PPA) had granted approval on January 10, 2024, for the government to procure equipment and machinery from the company at a total cost of US$178.7 million.

J.A. Plant Pool explained that both the PPA approval and the final contract clearly stated the total contract value and maintained that all payments made under the agreement were carried out strictly in accordance with the contractual terms.

The company further indicated that it had successfully supplied all machines and equipment required under the agreement to the Government of Ghana.

Management also expressed concern over what it described as widespread media publication of the suit before the company and its Executive Chairman were officially served with court processes.

According to the statement, the publicity surrounding the case has caused reputational damage to the company, the Jospong Group of Companies, and their local and international business partners.

J.A. Plant Pool and Dr. Siaw Agyepong therefore urged the public to disregard any suggestion of wrongdoing arising from the Attorney-General’s claims.

 

The company reaffirmed its commitment to transparency, accountability, lawful business conduct, and constructive engagement with the Government of Ghana and other stakeholders.
