TDC clarifies Tema C23 land dispute, says litigation limited to 361 acres

TDC Ghana Ltd has clarified that an ongoing land litigation involving the company, Trasacco Estates Development Company Limited and members of the Nii Tetteh Santeo family concerns only a specific 361-acre parcel of land occupied by Trasacco Estates and not the entirety of Tema Community 23 as being portrayed in some reports.

In a public notice issued by management, TDC Ghana Ltd stated that the matter stems from a ruling delivered by the High Court (Land Division) in Accra in Suit No. LD/0059/2015 involving the Nii Tetteh Santeo family, Trasacco Estates Development Company Limited, TDC Ghana Ltd and the Lands Commission.

The company stressed that claims suggesting that the whole of Community 23 is under dispute are misleading and inaccurate.

TDC Ghana Ltd further disclosed that it holds what it described as a valid and subsisting judgment in its favour against the Nii Tetteh Santeo family in the case of Nii Blabi Din Borketey Nkpa v. TDC, Suit No. FAL/186/12, dated November 8, 2016.

According to the company, the court in that case declared Communities 23 and 24 as part of the Tema Acquisition Area under the control and management of TDC Ghana Ltd.

Management noted that the judgment remains in force and has not been overturned or set aside by any higher court.

The company also announced that it has filed a Notice of Appeal to challenge the recent High Court ruling and intends to pursue all available legal remedies under Ghanaian law.

While refraining from commenting extensively on the merits of the pending appeal, TDC Ghana Ltd urged the public to disregard what it described as misinformation, speculation and unauthorised claims concerning ownership of lands within Community 23 beyond the 361-acre enclave currently under litigation.

The company reaffirmed its commitment to protecting lands under its management and safeguarding the interests of the state and the public.

TDC Ghana Ltd also advised prospective land buyers and stakeholders to exercise caution and conduct due diligence before engaging in land transactions within the affected area.
